Global Refugee Crisis – Preparing the Day After

First Commentary on the Pinheiro Principles
outlining displacement solutions

Geneva (2 November 2015) – On the occasion of their tenth anniversary, Scott Leckie, Director and founder of Displacement Solutions, an independent human rights organisation with extensive experience working on displacement and restitution issues, and Dr. Khaled Hassine today launched the first Commentary on the United Nations Principles on Housing and Property Restitution for Refugees and Displaced Persons – known colloquially as the Pinheiro Principles.

“The best solution to the plight of millions of refugees and displaced persons around the world is to ensure they attain the right to return freely to their countries and to have restored to them housing and property of which they were deprived during the course of displacement, or to be compensated for any property that cannot be restored to them. It is the most desired, sustainable, and dignified solution to displacement”, Paulo Sergio Pinheiro – the then Special Rapporteur on Housing and Property Restitution and current Chair of the Commission of Inquiry on Syria – said ten years ago when the Principles that were named after him were adopted by the UN Sub-Commission on the Promotion and Protection of Human Rights.

This holds true today more than ever: “If we want the millions of refugees around the world to be able to return to their homes, we must build the conditions for them to do so,” Scott Leckie stressed. “Housing and property restitution is an essential element of reconstruction and recovery in post-conflict situations and a precondition for return. The Day After in Syria and elsewhere must be prepared now.”

The Pinheiro Principles articulate standards regarding restitution procedures, institutions, mechanisms and legislation, while being grounded firmly within existing international human rights and humanitarian law. This first Commentary analyzes in considerable detail the legal contents of the Pinheiro Principles and the Principles’ application to refugee scenarios all over the world.
